The loss of Joslyn, 21 when she died, will haunt her family forever, her father said. “When someone you love, especially a child, is snatched away from you so quickly, when there is no time for goodbye, you are broken,” Michael Moynagh said. “I mean totally, carrying it with you to your grave, broken.” After two years, the grief is still fresh, he said. “You are still and always will be broken,” he said. “You go on, you think sometimes that you are happy, but you are not.” Nunes accepted the sentence of 2½ years at the house of correction with two years to serve. After that, Nunes will be on probation for seven years. He will have a curfew for his first year — from 7 p.m. to 7 a.m. — and will be subjected to random testing all seven years to ensure he is complying with the order to refrain from drugs and alcohol. Nunes must also spend one day a month working as a volunteer in a hospital or a facility that provides care to people recovering from traumatic injury. Nunes has accepted responsibility for the crash and was prepared to plead guilty to the crime the next morning when he was arraigned in District Court, his lawyer, Kenneth Van Colon, said. Van Colon recommended a sentence of two years in the house of correction. Prosecutor Stephen Nadeau recommended a sentence in state prison of three years. Nunes had been drinking heavily on the night before the crash, celebrating the 21st birthday of a friend. He and Moynagh spent the evening at the home of friends and at clubs in Providence, Nadeau told Connor. Nunes was driving north on Gardners Neck Road at 1:48 a.m., when his 2003 Ford Escape left the road and struck two utility poles, breaking both of them. Swansea Officer Christopher Ball reported that he arrived to find Nunes attempting CPR on Moynagh, who was severely injured. She died later that morning at Rhode Island Hospital. Moynagh’s mother, Joanne Robidoux, told Connor of the nightmare of being woken by the police and driving to Providence, not knowing exactly what had happened to her daughter. “I got to the hospital,” she said. “She had tubes everywhere. There was blood and wires and bandages and she was gone.” She added: “I have nothing. I am a shell of what I was.” Connor told the family they had his sympathy. “There is nothing this world can do to right the wrong that has been done,” he said. “I wish there was.” Connor said a sentence in the house of correction with a longer probation term offers punishment, but with rehabilitation for Nunes. “I wish there was a remedy to this, a remedy to make this to have never happened,” Connor said. “I wish there was a perfect sentence. There isn’t.” Nunes, who arrived in court with several family members, left the courtroom in handcuffs with court officers to begin his sentence.
